  • Employers must comply with various legal requirements including:

    • Paying employees at least the National Minimum Wage (NMW) or National Living Wage (NLW).

    • Deducting income tax and National Insurance contributions (NI) from employees’ wages.

    • Providing payslips that detail earnings and deductions.

    • Submitting payroll information to HMRC through Real Time Information (RTI).

    • Paying pension contributions in line with auto-enrolment rules.

 

RTI is a system introduced by HMRC where employers submit payroll data, including details of employees’ pay, tax, and National Insurance contributions, to HMRC on or before each payday. This helps HMRC maintain up-to-date records for individuals’ taxes and NI contributions.

  • National Minimum Wage (NMW): The minimum hourly wage that must be paid to workers under 23 years of age.

  • National Living Wage (NLW): The minimum hourly wage for workers aged 23 and over. The rates for both NMW and NLW are reviewed annually and vary depending on age groups.

The main payroll deductions include:

  • Income Tax: Deducted based on the employee’s income tax band.

  • National Insurance Contributions (NICs): Both employees and employers contribute to National Insurance, which funds state benefits and the NHS.

  • Pension Contributions: Employers are required to enroll eligible employees in a workplace pension scheme and contribute to it (auto-enrolment).

  • Student Loan Repayments: If applicable, deductions will be made for student loan repayments.

  • Other Deductions: Such as union fees, company benefits, or salary sacrifice schemes.

PAYE (Pay As You Earn) is the system used to collect Income Tax and National Insurance contributions from employees’ wages or pensions. Employers are responsible for deducting tax and NI and paying them to HMRC on behalf of employees.

Payroll data must be submitted to HMRC on or before the employee’s payday using RTI. This includes details of gross pay, deductions, and net pay. If payments to employees are delayed, the payroll must still be submitted on time.
